Terms and Conditions for the website vinothon-genussmarathon.de and registration for the Henkell 0.0 % Vinothon 2027

1. Scope and organiser

   These Terms and Conditions apply to the use of the website vinothon-genussmarathon.de, to newsletter subscriptions and to the booking of race entries and additional services for the 2nd Henkell 0.0 % Vinothon – Wiesbaden·Rheingau GenussMarathon on 17 April 2027.

   The Participation Rules apply in addition and govern the event itself. In case of conflict, the Participation Rules take precedence on matters of how the event is run, and these Terms take precedence on matters of contract and payment.

2. Conclusion of contract

   1. Registration takes place online via the RACE RESULT entry system. RACE RESULT handles registration, payment and timing on a technical level. The contracting party of the participant is exclusively WEC GmbH.
   2. The presentation of race entries and additional services on the website does not constitute a binding offer but an invitation to register.
   3. By completing the registration via the button clearly marked as subject to payment, the participant submits a binding offer. The contract is concluded upon electronic confirmation of the registration.
   4. The right to participate exists only after payment has been received in full.
   5. Registration is personal and non-transferable. Passing the race entry on to third parties is excluded.

3. Prices and payment

   1. All prices are in euros and include statutory VAT.
   2. The price displayed at the time of registration applies. Prices are staggered by registration period. A later price change gives rise to neither additional claims nor refunds.
   3. The available payment methods are shown during registration. Payment is processed via RACE RESULT and the payment service provider indicated there.
   4. Group discounts are granted exclusively during registration and cannot be applied retrospectively.

4. Additional services

   In addition to the race entry, further services may be booked, in particular a finisher shirt, participation in the pasta party and medal engraving. The deadlines set out in section 5 of the Participation Rules apply. Personalised services such as medal engraving become binding once that deadline has passed.

5. Right of withdrawal

   1. Race entry. There is no right of withdrawal for the booking of a race entry pursuant to section 312g (2) no. 9 of the German Civil Code (BGB). This concerns a service connected with leisure activities for which a specific date is provided. The cancellation scheme under section 6 applies instead.
   2. Additional items constituting goods. Where goods are ordered as part of the registration that are not made to customer specification, a statutory right of withdrawal applies. Details are set out in the separate withdrawal policy.
   3. Personalised services. There is no right of withdrawal for services made to customer specification or clearly tailored to personal requirements, in particular medal engraving, pursuant to section 312g (2) no. 1 BGB.

6. Cancellation by the participant

   The date on which the cancellation reaches the organiser is decisive. A proportion of the basic entry fee is refunded as follows:

   • until 31.10.2026: 85 %
   • 01.11.2026 to 15.01.2027: 55 %
   • 16.01.2027 to 15.04.2027: 25 %
   • from 16.04.2027: no refund

   Optional additional items are not included in this proportional refund. The deadlines set out in section 5 of the Participation Rules apply to them. Cancellations are reviewed and processed manually.

7. Changes, cancellation and force majeure

   1. Changes to the schedule, routes, start times or programme are reserved, provided the overall character of the event is maintained. The published routes are subject to official approval.
   2. The organiser may change, postpone or cancel the event for safety reasons, due to official requirements, weather, force majeure or other circumstances beyond its control.
   3. If the event is cancelled entirely, the entry fee paid will be refunded unless otherwise required by law. If the event is postponed, the race entry remains valid for the replacement date. Further claims, in particular for travel or accommodation costs, are excluded.

8. Newsletter

   1. The newsletter is sent via Brevo (Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany).
   2. Subscription uses the double opt-in procedure. The data is used exclusively for sending the newsletter.
   3. Consent is voluntary, is not a condition of participation and may be withdrawn at any time with effect for the future. Brevo processes data under a data processing agreement pursuant to Article 28 GDPR.

9. Copyright

   All content on vinothon-genussmarathon.de is protected by copyright. Any use beyond the cases permitted by law requires the prior written consent of the organiser.

10. Liability

    The organiser is liable without limitation in cases of intent and gross negligence, and for injury to life, body or health. In cases of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded. Mandatory statutory liability, in particular under the German Product Liability Act, remains unaffected.

    Participation in the event itself is at the participant’s own risk. Details are governed by the Participation Rules.

11. Data protection

    The organiser’s privacy policy applies. The notices of RACE RESULT and of the payment service provider indicated during registration apply in addition.

12. Consumer dispute resolution

    We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions and language

    German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this applies only insofar as it does not deprive the consumer of the protection of mandatory provisions of the state in which they have their habitual residence.

    For contracts with businesses, the place of jurisdiction is the registered office of the organiser. For consumers, the statutory rules on jurisdiction apply.

    This is a translation provided for convenience. In the event of any discrepancy, the German version of these Terms and Conditions shall prevail.

    Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
